Participation Waiver

ATU Campus Recreation runs on Fusion Go.  Members can start by completing the mandatory waiver in the app so you can swipe into the gym with your student ID and take part in everything Campus Recreation has to offer.  Below is the text of the waiver found on Fusion Go should you need to review it.

Participant Consent, Release and Waiver of Liability Agreement

This Participant Consent, Release and Waiver of Liability Agreement (“Agreement”) is given on the date set forth below to Arkansas Tech University (“ATU”).

For purposes of this Agreement, the term “ATU” shall refer to and mean Arkansas Tech University,  any past, present and future members of the ATU Board of Trustees, any employee, representative or agent of ATU, and any entity associated with, or controlled by, ATU.

Please read this Participant Consent, Release and Waiver of Liability Agreement (“Agreement”) carefully before signing.  This is a legally binding document.  This completed and signed Agreement must be submitted before any person is allowed to use any/all Campus Recreation controlled or designated facility or space (including the Campus Recreation Center in the Ferguson Student Union, Intramural Fields, Sand Volleyball Courts, Clary Pickleball Courts, designated program/event space on or off campus, etc…), participate in Intramural Sports, participate in Outdoor Recreation experiences and activities (both on and off campus), participate in Club Sports, participate in Fitness Programs, or any other activity, event, or experience offered by Campus Recreation at ATU.

RELEASE OF LIABILITY

In consideration for my being permitted to participate in, utilize, rent, or otherwise use ATU Campus Recreation activities and equipment that include, but are not limited to, fitness classes, fitness center or gym usage, sport clubs, intramural sports, outdoor recreation experiences and events (including rentals of bicycle, canoe, kayak, hammock, and related items) and open and outdoor recreational sports, experiences and activities, either on or away from University property (“Activities”), I, for myself, my spouse, legal representatives, heirs, next of kin, or assigns, hereby forever release, waive, covenant not to sue, and discharge ATU from any and all liability to me, the undersigned, or my spouse, legal representatives, heirs or assigns, for any and all loss, claims, or damages that I may have or that may hereafter accrue, resulting from the death or injury to myself, whether caused by the active or passive negligence or otherwise of ATU, that arise while I am participating in the Activities.  

IDENTIFICATION OF POSSIBLE RISKS

I acknowledge the following: (1) all Activities involve and pose risk, inherent or otherwise, that cannot be entirely eliminated that may jeopardize my safety, health, and well-being; (2) I am aware that some Activities are violent contact sports; (3) I understand that the dangers and risks of participation may include  INJURIES THAT OCCUR BEFORE, DURING, OR AFTER MY PARTICIPATION IN ACTIVITIES, AND THAT THESE INJURIES COULD INCLUDE, BUT ARE NOT LIMITED TO, PHYSICAL, MENTAL, OR EMOTIONAL INJURY, TRAUMA DISABILITY (INCLUDING SHORT-TERM, LONG-TERM, AND/OR PERMANENT), ILLNESS, OR EVEN DEATH; and (4) I am aware that participating in Activities will involve risks for injuries which may include, but are not limited to, - PHYSICAL HARM, CONTAGIOUS DISEASE OR VIRUS, ASPHYXIATION, GASTRO-INTESTINAL DISTRESS, BROKEN BONES, SPRAINS, FRACTURES, FALLS, REDUCED LUNG CAPACITY, ORGAN FAILURE, PARALYSIS, BLINDNESS , SUFFOCATION, DISMEMBERMENT, - NECK OR SPINAL INJURIES, WHICH MAY RESULT IN PARTIAL OR COMPLETE PARALYSIS, BRAIN DAMAGE, TEMPORARY OR PERMANENT DISABILITY, - INJURY TO INTERNAL ORGANS, BONES, MUSCLES, JOINTS, AND OTHER ASPECTS OF THE MUSCULAR SKELETAL SYSTEM, AND - INJURY OR IMPAIRMENT TO OTHER ASPECTS OF MY BODY, OR DEATH. I further understand and acknowledge that the dangers and risks of participating may result not only in injury, but also serious impairment of my future abilities to earn a living, to engage in other business, social, and recreational activities, and generally to enjoy life. These risks, dangers and hazards derive from the nature of the activities and the environment in which they take place. I agree that if I am not knowledgeable of the risks associated with these Activities, I will obtain proper instruction to gain a full appreciation thereof.

ACKNOWLEDGEMENT OF RISK

Because of the dangers of participating in the above Activities, I acknowledge and understand the importance of following rules and regulations established by ATU and Campus Recreation at ATU. I hereby agree to obey such rules, regulations, and instructions.

I further acknowledge that I am in good physical condition and do not know of any medical or physical condition or other reason that I should not participate in Activities, or which could interfere with my safety in such Activities, or else I am willing to assume—and bear the cost of—all risks that may be created, directly or indirectly, by any such condition, whether known or previously unknown. Further, I state affirmatively that the University does not require my participation in Activities. My participation in Activities is purely voluntary, and I elect to participate despite the risks and known or unknown dangers associated with Activities.

Therefore, I expressly, knowingly, and voluntarily accept and assume all risk of injury, loss of life, or damage to property arising out of my participation in Activities.

HOLD HARMLESS AND WAIVER OF LIABILITY

For myself, and all of my heirs, personal representatives, successors and assigns, or any other persons claiming by or through me, I do hereby forever waive, release and relinquish any and all claims, demands, causes of action, liabilities, costs or expenses (including, but not limited to, attorneys’ fees) (all of the foregoing being referred to collectively as “Claims”), whether current or arising in the future, against ATU which are associated with, or arise out of or in any manner are related to, resulting from my voluntary use or participation in or in any way connected with such recreational programs and athletic activities, including, but not limited to the fitness center, gymnasium, fitness room, intramural fields, sand volleyball courts, pickleball courts, designated event/activity space, offsite recreational experiences and activities, and any other experiences, services, programs/events, and/or facilities and designated spaces in use by Campus Recreation at ATU. The waiver and release set forth herein is intended to be as broadly interpreted as permitted by applicable laws and waives and releases all Claims under any federal or state law, as well as any common law cause of action, whether in contract, tort or any other legal theory.

ABSENCE OF INSURANCE POLICY OR COVERAGE

I RECOGNIZE AND ACKNOWLEDGE THAT ARKANSAS TECH UNIVERSITY DOES NOT CARRY ANY TYPE OF ACCIDENT/INJURY, LIABILITY, OR HEALTH INSURANCE POLICY FOR PARTICIPANTS ENGAGING IN THE ACTIVITIES IN CAMPUS RECREATION PROGRAMS, EVENTS, EXPERIENCES, AND SERVICES. I ACKNOWLEDGE THAT ATU WILL NOT COVER ME, MY FAMILY, HEIRS, REPRESENTATIVES, OR ASSIGNEES IN THE EVENT OF ACCIDENT, INJURY, ILLNESS, OR DEATH.

By voluntarily signing this Participant Consent, Release and Waiver of Liability Agreement or selecting “Accept Terms & Conditions” to electronically sign this Agreement, I acknowledge and represent: (1) I have fully read and understand the Agreement’s contents; (2) I sign or alternatively select “Accept Terms & Conditions” to electronically sign it, for full and adequate consideration, fully intending to be bound by the same. By signing this Agreement, I expressly agree that the foregoing agreement is intended to be as broad and inclusive as is permitted under Arkansas law and that if any portion thereof is held invalid, it is agreed that the remainder of the Agreement shall continue in full legal force and effect.

I HAVE READ THIS Participant Consent, Release and Waiver of Liability Agreement, AGREE THAT NO ORAL REPRESENTATIONS, STATEMENTS, OR INDUCEMENTS APART FROM THE FOREGOING WAIVER HAVE BEEN MADE, UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS.

By signing this document, I certify that I have read and understood each and every provision contained herein, and agree to each one, and that I am at least eighteen (18) years of age.  A copy of this completed and signed document is available upon request.

By signing this document, I certify that I understand that my actions while participating in Campus Recreation need to align with the Student Handbook of Arkansas Tech University, and the terms outlined in the Usage & Participation Procedures and Information set forth by Campus Recreation.  I understand I can locate this document at https://www.atu.edu/campuslife/campusrecreation/resources.php and/or I can obtain a copy from Campus Recreation staff at any time.

Further, I understand that this Agreement shall be effective during the entire period of my enrollment or employment at the institution when engaged with any program, event, experience, or service of ATU Campus Recreation.  Additionally, all university policies and regulations, applicable laws, student handbook, employee handbooks, and/or related guiding documents apply at all times.

The vision of Arkansas Tech University's Campus Recreation is to provide opportunities for a diversified population to recreate, exercise, and socialize through a variety of programs including intramural sports, fitness, outdoor recreation, club sports and special events.

ABOUT CAMPUS RECREATION

 Campus Recreation provides participation and engagement opportunities in a variety of sport, fitness, and recreational (both indoor and outdoor) events that help stimulate student learning and personal development while enhancing the quality of life for Arkansas Tech students.

Students have the opportunity to participate individually or as part of a team in events such as flag football, softball, soccer, basketball, bowling, sand volleyball, and more through our comprehensive Intramural Sports program.

Our Outdoor Recreation program provides a variety of services that encourage students to take advantage of all the fantastic outdoor opportunities present in our local area.  Students can, free of charge, check out mountain bikes, kayaks, canoes, commuter bikes, hammocks, and more through Outdoor Recreation.

Students have multiple opportunities to engage in fitness programs and services, regardless of ability and current fitness level. Our Fitness program includes a full line of top-end cardio, free weight, cross functional, and selector series equipment.  Additionally, we offer classes from beginner to expert in our fitness and spin studios.  

Campus Recreation also works with students who would like to engage in sports and activity at the Club Sport level.  These sports are non-NCAA sanctioned teams that participate locally, regionally, and nationally depending on the sport.  Clubs vary from year to year and our staff is always willing to meet with students to try and expand offerings in Club Sports. 

GENERAL USAGE & PARTICIPATION IN CAMPUS RECREATION

Participation in all related Campus Recreation programs, events and services is restricted to currently enrolled students, and faculty/staff members who have purchased an employee membership.  Enrolled students are further defined as students who are enrolled in classes on the Russellville campus who pay the Student Union/Recreation Center Fee (this excludes concurrent enrolled students).

Any student choosing to participate in all related Campus Recreation programs, events, and services are required to have a completed Participant Consent, Release and Waiver of Liability Agreement on file

ATU Campus Recreation runs on Fusion Go.  Members can start by completing the mandatory waiver in the app so you can swipe into the gym with your student ID and take part in everything Campus Recreation has to offer.

Once your waiver is complete, use Fusion Go to view daily facility schedules, and to browse and register for fitness classes. You can also dive into Outdoor Recreation and explore available checkout items including mountain bikes, kayaks, hammocks, and more. Plus, see which intramural sports and upcoming IM leagues are available.

You must have a signed waiver through the Fusion Go app before you are able to enter the Campus Recreation Center, use Outdoor Recreation services, or participate in intramural sports.

Use of the Campus Recreation Center within the Ferguson Student Union is limited to currently enrolled students at Arkansas Tech University and current faculty/staff members of Arkansas Tech University who possess a valid membership. Enrolled students are further defined as students who are enrolled in classes on the Russellville campus who pay the Student Union/Recreation Center Fee (this excludes concurrent enrolled students).  A Participant Consent, Release and Waiver of Liability Agreement is required of ALL participants.

Memberships are available for purchase for Arkansas Tech Faculty and Staff employees. A valid membership is required for entry into the Campus Recreation Center. Two membership periods are available:

  • July 1 – June 30 (Annual Membership)
  • Membership fee:  $240
  • Optional add-on:  Access to fitness classes for an additional $80
  • January 1 – June 30 (Mid-Year Membership)
  • Membership fee:  $120
  • Optional add-on:  Access to fitness classes for an additional $40

Membership fees and optional fitness class access are non-transferable and apply only for the designated membership period.

All policies and procedures of Arkansas Tech University are applicable at all times when participating in Campus Recreation programs, events, and services in any designated location.

Use of the Campus Recreation Center

Only authorized members, with proper identification (ATU official ID Card) are permitted inside the Campus Recreation Center.  Guests and/or visitors are not permitted inside the facility.

All persons entering the facility are required to officially check in at the welcome desk and obtain a hand towel upon check-in when planning to use any of the fitness equipment or participate in fitness classes.  Patrons who allow non-members into the facility in any fashion will be referred to the Office of Student Conduct and may have usage restrictions imposed.

Use of any portion of the facility for the purpose of personal training instruction, or the like, for profit or otherwise, is prohibited.  Advertising, solicitation, and/or marketing personal training services that are to occur within any portion of the facility is not permitted.

Organized, promoted, or coordinated NCAA affiliated team, position, or group practices, workouts, sessions, or the like, are not permitted.  Consideration for use of specialty rooms when not in use or during non-peak periods by a sanctioned NCAA team fall to the discretion of the Director of Campus Recreation. 

Responsibility for general supervision of the fitness areas and courts is provided by identified staff members directly in charge of the activity or area. Students provide primary supervision for the facility and act with the full authority of a full time Campus Recreation staff member.

Entrance and exiting of Campus Recreation Center is to occur through the main entry point inside the Ferguson Student Union corridor.  Emergency exits are located throughout the facility and are to be used in only that manner.

Lockers are provided at no cost and should be used to keep personal items from any activity area, floor, or lobby seating.  Lockers are DAY USE only and are required to be cleared out by the end of each day. Campus Recreation is not responsible for lost, stolen, or damaged personal property.

During any participation or attendance within the Campus Recreation Center, athletic attire is required at all times. This promotes personal safety as well as the maintenance of machines, equipment, and floors within the facility.  Open toed shoes, boots, sandals, or the like are not permitted. Non-marking running shoes are required. Jeans or other hard fabric constructed shorts or pants, items with zippers/studs are not permitted.  Athletic pants or shorts are required.   In general, street clothes are not permitted.

Participants must wear clothing that fully covers the chest, back, midsection, gluteal area, and groin while using Campus Recreation facilities.  Additionally, shirts must remain on at all times. 

Personal equipment items for fitness or play use within the Campus Recreation Center are generally not permitted.  Please discuss such items with Campus Recreation staff prior to bringing it to the facility.

Food items are not permitted within the Campus Recreation Center at any time.

Drinks must be contained in a bottle with a secure lid at all times.

Personal speakers are not permitted in any location within the Campus Recreation Center. Photography, videography, and other forms of recording may be restricted in certain areas of Campus Recreation facilities to protect participant privacy and maintain a comfortable recreational environment.  Campus Recreation staff reserve the right to limit or prohibit recording activities when deemed appropriate.  

Disruptive behavior, profanity, or unsafe play may result in removal from the facility.

Use of the Fitness Areas

Fitness areas are designed to provide a safe, inclusive, and respectful environment for all users.

Closed-toe athletic shoes and appropriate workout attire must be worn at all times.

Participants are expected to wipe down equipment before and after use, and return any/all equipment to its designated location.

Dropping weights, misuse of equipment, or unsafe lifting practices are prohibited. Spotters are strongly encouraged when lifting heavy loads.

Chalk use is not permitted in any fitness area in the Campus Recreation Center.

Personal belongings must be stored in lockers or designated storage areas and may not obstruct walkways or equipment.

Organized, promoted, or coordinated NCAA affiliated team, position, or group practices, workouts, sessions, or the like are not permitted.  Consideration for use of specialty rooms when not in use or during non-peak periods by a sanctioned NCAA team fall to the discretion of the Director of Campus Recreation. 

Food items are not permitted within any Fitness area in Campus Recreation Center at any time.

Drinks must be contained in a bottle with a secure lid at all times.

Staff reserve the right to enforce time limits during peak hours to ensure equitable access.

Disruptive behavior, profanity, or unsafe play may result in removal from the facility.

Use of the Gym Courts

The Gym Courts are multi-use spaces designated for recreational play, intramural sports, and special events.

Non-marking athletic shoes must be worn at all times.

Court availability is subject to scheduled programs, intramurals, club sports, and special events. Open recreation use operates on a first-come, first-served basis unless otherwise posted.

Dunking or hanging on rims is prohibited for participant safety and to prevent equipment damage.

Personal music devices must be used with headphones unless authorized for a reserved event.

Organized, promoted, or coordinated NCAA affiliated team, position, or group practices, workouts, sessions, or the like are not permitted.  Consideration for use of specialty rooms when not in use or during non-peak periods by a sanctioned NCAA team fall to the discretion of the Director of Campus Recreation. 

Food items are not permitted within the Gym Courts at any time.

Drinks must be contained in a bottle with a secure lid at all times.

Participants are expected to demonstrate sportsmanship and respect toward others.

Disruptive behavior, profanity, or unsafe play may result in removal from the facility.

Use of the Specialty Rooms

Specialty rooms are reserved for structured programming, classes, and approved reservations.

Access may be limited to scheduled class participants during designated times.

Participants must arrive on time; late entry may be restricted once class begins for safety and instructional continuity.

Proper athletic attire and closed-toe shoes are required unless otherwise specified (e.g., yoga or barre).

Organized, promoted, or coordinated NCAA affiliated team, position, or group practices, workouts, sessions, or the like are not permitted.  Consideration for use of specialty rooms when not in use or during non-peak periods by a sanctioned NCAA team fall to the discretion of the Director of Campus Recreation. 

Food items are not permitted within the Specialty Rooms at any time.

Drinks must be contained in a bottle with a secure lid at all times.

Equipment should be returned to its original location after use, and all surfaces must be wiped down following sessions.

Bags and personal items should be stored in designated areas outside of workout space.

For safety reasons, only authorized staff may operate audiovisual systems, projectors, or studio equipment. Participants must follow instructor or staff guidance at all times.

Disruptive behavior, profanity, or unsafe play may result in removal from the facility.

Use of Outdoor Recreation Services  

Outdoor Recreation services and related equipment check-outs are available to currently enrolled Arkansas Tech students and faculty/staff members with an employee membership.

A valid ATU Official ID is required for any equipment checkout.  Currently enrolled students are able to check-out at no cost; bicycles, kayaks, hammocks, canoes, slacklines, and other related outdoor gear.

Participants must complete any required waivers and safety orientations prior to participation.

Proper attire and safety equipment must be worn at all times. Staff instructions must be followed during all activities.

Equipment rentals are the responsibility of the individual checking them out and must be returned by the designated time to avoid late fees. Damaged or lost equipment may result in replacement charges.

All equipment that is checked out should be used for its intended purpose by the ATU student or member who checked the item out.  Students may be responsible for repairs and possible replacement of equipment should it be determined that it was not used in its intended manner.

Participation in Intramural Sports

Intramural Sports are offered throughout the fall and spring terms for currently enrolled Arkansas Tech students and faculty/staff members who possess an Employee Membership.

Fusion PLAY is the app that is required for participants interested in Intramural Sports.  Fusion PLAY is the connection point for all sports.  You can create and manage your roster, connect with teams, register for upcoming sports and events and connect with fellow ATU students. 

Sport offerings, schedules, and individual and team sign up information can be found on Fusion PLAY and our web-site, www.atu.edu/campusrecreation .

In applicable intramural sports, student officials are provided.  These student officials are sport specific trained by staff in Campus Recreation.  Participants are expected to show sportsmanship and respect to all officials at all times.

Each intramural sport has sport specific rules and regulations.  These are made available to team captains and participants prior to the start of each sport season.

Disruptive behavior, profanity, or unsafe play may result in removal from intramural sport participation.

Participation in Club Sports

A variety of club sports are offered each year for currently enrolled Arkansas Tech students based on current student interest and involvement. 

Club sports are non-NCAA sanctioned and primarily led by current Arkansas Tech students and faculty/staff advisors.

Current club sports, contact information, schedules, and meetings can be found on our web-site, www.atu.edu/campusrecreation . 

Some club sports have specific rules and regulations.  These are made available to team members, advisors and related participants at any time.

The Bike Shop

Located within Outdoor Recreation, The Bike Shop provides services to currently enrolled Arkansas Tech students and faculty/staff.

Led by student employees who have bicycle repair experience and knowledge, students and faculty/staff are able to bring their personal bicycles over for general repair and upkeep at no cost.  Bicycle owners are responsible for the cost of any additional replacement parts needed for repairs.

Student staff in The Bike Shop provide regular maintenance and up-keep of all current bicycle inventory available for student and member check-out.

Esports Gaming Center

Located in the main hallway of the Ferguson Student Union, the Esports Gaming Center is the central hub for all Esports Club Teams and students who are members of the Esports Club.

This center consists of two team rooms and central lounge with open gaming computers, console gaming area, and a viewing area for streaming matches.  Each team room consists of six gaming computers for use by the various Esports Club teams.  These team rooms are not open for use to the public unless approved by the Esports Club leadership and Campus Recreation staff.

The Esports Club will host ‘open hours’ several times per week during the traditional academic calendar where guests can learn the games of play on the open computers.  Students and faculty/staff are encouraged to come to the center to watch official ATU Esports matches during the various gaming seasons.

General Equipment Check-Out

Campus Recreation provides numerous ‘day’ check out items at the Welcome Desk inside the Ferguson Student Union (in addition to items at Outdoor Recreation).  These items area available for students to check out for use across campus.  Items include, but are not limited to; baggo bags, pickleball paddles and balls, ping pong paddles, and volleyballs for use on concrete boards, table and courts at the Clary Pickleball Courts, outdoor basketballs for use on the M-Street outdoor court, and other seasonal items.

IF there is equipment of a service that we do not currently offer, place contact the Campus Recreation staff for consideration.

CONTACTING CAMPUS RECREATION

Campus Recreation administrative offices are located within the Ferguson Student Union. The main office is located in Suite 203 on the second floor of the Campus Recreation Center. Additional staff support is available in the Outdoor Recreation Office (Room 137), located on the first floor of the Ferguson Student Union.

Campus Recreation staff may be contacted in person, by email at campusrec@atu.edu, or by phone at (479) 880-4455. Office hours may vary based on seasonal programming and operational needs; however, offices are generally staffed during normal university business hours.

IM Leagues is an online platform used to efficiently manage intramural sports and recreational activities. It allows users to create teams, join leagues, register for events, and track schedules, scores, and standings in one convenient location.

Campus Recreation staff use IM Leagues to organize leagues, communicate with participants, and oversee games. Students can access it via web browser or the IM Leagues app to stay connected and engaged in intramural programming.

Sportsmanship Policy

Unsportsmanlike Conduct Penalties (Players, Fans, Coaches)

  • 2 unsportsmanlike conducts → Ejection + must sit out next game
  • 3 total (season/tournament) → Removal from tournament/season
  • 4 total (semester) → Removal from all IM events
  • Team 3 in one game → Forfeiture of game
  • Team 4 in season/tournament → Removal from tournament/season

Sportsmanship Ratings

Each team receives a sportsmanship rating from officials and/or field supervisors after each game:

  • 4 – Excellent: Outstanding cooperation and full support of officials
  • 3 – Above Average: No incidents of poor sportsmanship; respectful behavior
  • 2 – Average: Minor isolated issues; not team-wide behavior
  • 1 – Below Average: Frequent questioning of officials, profanity, or lack of control of spectators
  • 0 – Poor: Ejection, failure to cooperate, unsafe or abusive behavior, or inability to control fans
  • Default = 2 rating
  • Forfeit or player ejection = 0 rating

Playoff Eligibility

  • A minimum 3.0 cumulative sportsmanship rating is required to qualify for playoffs
  • A 3.0 or higher per game is required to advance during playoffs
  • Teams receiving a 3.0 or lower in playoffs must meet with the IM Director before their next contest
  • Any team receiving a 0.0 in a playoff game is disqualified and subject to suspension determined by the IM Director

Summer Hours (subject to change based on facility usage and building needs)

  • Monday – Thursday: 7:00 a.m. – 7:00 p.m.
  • Friday: 7:00 a.m. – 2:00 p.m.
  • Saturday: 10:30 a.m. - 3:00 p.m.
  • Sunday: 5:00 p.m. – 9:00 p.m.
